Signing into any contract or agreement with Logo Design Viz for product or services or both provided by Logo Design Viz, including without limitation ordering any product or services through the Logo Design Viz website (hereinafter referred to as your "Contract with Logo Design Viz")
Services and/or product referred in Terms & Conditions shall include without limitation logos, design, name, graphics, stationery, brochures, screen savers, web design, printing services, corporate gift items, marketing materials, search engine marketing or other similar material or information whether or not protectable and all future products and services offered by Logo Design Viz.
You are not recommended to order any products or services or enter into a contract if you are not willing to adhere to any provision of these Terms and Condition of Logo Design Viz. These Terms & Conditions are included by default into your contract. If any of the stated provisions of this contract conflicts with your contract then stated provision in our contract will be revised to be in consistence with your contract.
This contract can be changed, updated and modified any time with notification by email or any other means. You are responsible to regularly monitor these "Terms & Conditions". Logo Design Viz shall not be accountable for any modification, amendment, suspension, discontinuation or any other changes by third party and you also acknowledge and agree to this.
CMYK is the colour mode by default, unless specified that Pantone (PMS) is required before the start of the project. Any kind of format change after the start of the project will be charged additionally.
Main file format will be Adobe Illustrator format (.ai) format. All the fonts in the file will be converted to outlines. File formats of Freehand, Windows Meta File (.wmf), JPEG, PDF, GIF and TIFF will also be provided. Additional format can be furnished on request only.
Our payment terms are full payment in advance. We will start the project as soon as we receive the payment. You can view your designs in JPG format by logging on to the client panel which can be accessed by login into our client panel by your user id and password which Logo Design Viz will provide you on your email address which will be required on time of placing order. We will not be held responsible if we are given invalid email address and any kind of email filtration system on your side hindering our email to be delivered. Logo Design Viz will not be held responsible for late service charges and thus will not refund any fee either for this reason.
When we are upgrading our system or software the client panel may not be accessible and we will therefore email you your designs.
Logo Design Viz will be at liberty, in its exclusive and unconditional discretion, to refuse to deliver product or service unless full payment has been received. Logo Design Viz will also update you for any additional charges prior to beginning of its project.
Logo Design Viz ensures that our customers get a complete freedom of making a right decision. Logo Design Viz offers 100% Money Back Guarantee to our customers on all products, if the provided requirements of the client are not fulfilled.
Logo Design Viz will only refund in case its management believes that Logo Design Viz has not provided its services and product in efficiently and effectively as promised. You have to fill a refund request form and if a refund request is granted cash will be granted as mentioned in 'Logo Design and Refund Policy'. If your request for refund is granted Logo Design Viz will not refund U.S.$ 47.00 for administration charges and for the services that have already been provided.
Refund is also possible in case the Logo Design Viz terminate or cancel your contract other than violation or non performance.
No refund is possible in case of continuous idleness of contact by customer for more than 90 days or greater.
Logo Design Viz will not entertain any refund request if the provided specifications are fulfilled or if the client has not provided correct specifications. Following are the points that need to be provided by the client while giving any order;
Logo Design Viz will also update the clients after the completion of each phase of the project and will also share the latest status of the project. Logo Design Viz will not fulfill the refund request if the client has finalized the project and wants to leave it for any reason. Logo Design Viz offers unlimited revisions to our customers so that we provide them what they have in their mind. We also make sure that no client comes to the stage of refund because we believe in quality and provide everything what it takes to make our client's business outshine.
Logo Design Viz will not refund U.S.$ 47.00 along with handling and processing fee from the total amount for the first draft of the logo. If you have request for the refund on the other services in your package after finalizing the logo, Logo Design Viz will only refund the value of services that were not delivered (for bundle deals only)
Logo Design Viz shall deliver your product and/or service after completion in accordance with the terms and condition described in the contract to a temporary place for your review. After the completion and delivery Logo Design Viz will explain you via email to how to access the temporary place to review your product and/or service. From the date of delivery you will have 60 days to confirm Logo Design Viz in writing for acceptance or rejection of the product and or service, failure of providing rejection in writing for the product and/or service within 60 days shall be considered as acceptance of the product and/or service. Detailed explanation of rejection shall be required by Logo Design Viz in case you reject within the 60 days period, Logo Design Viz shall provide you with a substitute or alternate product or service within its reasonable capabilities. Logo Design Viz shall deliver the product and/or service, or substitute/alternate product or service to a place and in format as agreed on the contract only when written acceptance is received.
Having no contact of phone, email, written or in person for more than 60 days from the last modification in the project, it shall than be considered closed. Reopening of the project will only be at discretion of Logo Design Viz.
Any notification to Logo Design Viz written, verbal or in person confirming finalizing of any product (logo design, web design, graphic design, web development and stationery design etc.) shall be considered 'completed' or 'finalized'. Logo Design Viz will send the final files by email. Logo Design Viz Satisfaction Guarantee policy will be fulfilled after the acceptance or finalization of any files. Any other design, logos, brochure, web design and additional graphics etc. that was provided to you but you have NOT finalized will be considered property of Logo Design Viz and cannot be used by you in any way without getting prior consent and receiving written permission from Logo Design Viz.
Our standard turnaround time for the initial draft and further revisions is three (3) to five (5) working days. Your first samples will be delivered as per your package description. Urgent projects will be delivered on next business day (not counting major holidays) Packages that comprise of stationery designs will also have next working day delivery time if a customer has purchased the expedited service.
Logo Design Viz cannot be held liable for NOT meeting deadlines self imposed by the clients without prior approval in writing from both parties. Logo Design Viz, in any case, will not be responsible for delays that occur in not meeting deadlines due to partial / incomplete information provided by the client or a late or delayed feedback / response from the client.
We need our clients to complete our internal creative brief (Either through email, online or faxed) entirely in order to meet the requirements of your design. If we don't get the full creative brief as per our requirement, we will notify you accordingly and will not process until the said process (creative brief) is completed entirely. If you, the client, request us to carry on with an incomplete creative brief and you are not fully content with the first draft, in this case you will have to purchase the second draft.
Unless otherwise stated and negotiated with Logo Design Viz, the client is 100% responsible for giving us the content (with complete wording and information) for their website in a completely prepared format (that can be cut and paste onto the website) Logo Design Viz, in no way, is responsible for spelling mistakes, grammatical errors or editing work. Logo Design Viz will not be responsible for the delays either client NOT providing the content or incomplete one. Content also includes the requirement of PHOTOS, that you want to be posted alongside the content. Client is solely responsible for providing photos or photo direction to Logo Design Viz.
Once we have designed a concept that you are satisfied with, you must give your approval and finalize the concept. After your finalization, our web designing team will convert your design of your webpage into HTML. During this phase, it is very important to double check the website and make certain that you don't need any added design changes. Only the text will be editable after this stage and all changes in design pertaining to headers, footers, site menu or navigation bars will incur extra charges.
As soon as the idea for the home webpage is finalized, your web designer will start converting the design from an image to a proper HTML page and will also create the succeeding pages from using the content you provided earlier. At this exact stage, your text will be included into the website. The completion time of this stage is 4 business days. If you require any additional changes in the text, you can do so in this step. After all the text is integrated, we will send you the initial practical draft of your website (not including any development work, for example, Contact Us form or Database) next you can approve the whole website in its entirety or can ask for text modifications via your Client Panel. The standard format for each and every document on the World Wide Web is since HTML (Hypertext Markup Language), it is vital that this is done before your website goes live. The completion time is 4 working days. Remember, once this procedure is underway, you won't be able to make design modifications without extra charges being incurred.
It is recommended that you review and test for all functionality and approve your site before finalizing through Client Panel. If your website includes any further work such as database or dynamic contact form, this can be added later after you approve the functionality of your HTML draft.
Web ready files will be provided to you by Logo Design Viz, In order to make your site go online you have to give the files to your web master
In order to re-open account which were left inactive for more than 120 days are subject to in-activity fee. Inactivity includes no revision request, email requesting for revisions or phone calls about the design of the project). The in-activity fee covers search, re-design/project acquaintance, restructuring of associated designer's workload.

Any proprietary information that you will provide to the Logo Design Viz or refer to Logo Design Viz in relation with your Contract is confirmed that you will represent give warranty that you are the owner or have exclusive rights for it, this includes without limitation any and all copyright, graphics, logos, designs, written copy or content for any use, to include reproduction for web design and brochures/flyers and trade names or marks and all other similar information or material.
The title, exclusive right and interest in and to the services and/or products provided to you or that such product has no representative or warranty by Logo Design Viz, including breach of intellectual property and proprietary rights of you or third party by such product or services.
In protecting the products and/or services delivered under your contract Logo Design Viz will not take any action, in the United States or any other jurisdiction, to use such products and/or services or to obtain trademark, copyright or similar protection of such products and/or services without any warranty or representation and will deliver on "AS IS" basis
Logo Design Viz will convey, assign, deliver and transfer all of its title, rights and concern in products and or services developed under your Contract upon your acceptance and after full payment to Logo Design Viz. Any other products and/or services not accepted by you due to rejection or provided as samples or otherwise not provided by Logo Design Viz remain property of Logo Design Viz at all times and you have no right on such services or and products.
Logo Design Viz still have the right to use products and/or services regardless of delivery and acceptance by you, as promotional or display purposes and also retains and reserves royalty free and perpetual right on it. Logo Design Viz can grant request for duplicate or any other products or/and services developed by Logo Design Viz or any other company if notarized, written grant is provided from them company.
Logo Design Viz specializes in logo design and custom logos, we can provide with a similar feel and look as the design you requested and can provide you with an original and new design you are pleased with. If we cannot deliver a matching design to an already designed logo or trademark, no refund would still be provided.
Your order for any product or services, your contract and your access to Logo Design Viz website can be rejected, cancel, terminate temporarily or permanently for any reason whatsoever at any time without prior notice and in its sole discretion by Logo Design Viz. Logo Design Viz shall not be held liable to any third party or you for any rejection, termination or cancellation of your order, your contract and your access to Logo Design Viz website. Only other than breach and non performance under your Contract, Logo Design Viz shall return any pre-paid amounts relating to canceled, terminated or the rejected, contract or order.
Information, software, codes, products, services, text, graphics, logos, or other items or materials provided or offered by Logo Design Viz are provided 'AS IS' without any express or implied warranty of any kind. Logo Design Viz makes no warranty that it will provide its products or services without any defects or errors and on timely and secure method. Nor does it offer warranty that it will infringe on any thirds party's intellectual property or proprietary rights. Logo Design Viz also does not warrant that you will meet your expectations on use of their products or services. Logo Design Viz disclaim all implied warranties of any kind including without limitation warranties of suitability, merchantability, breach of suitability for a particular purpose or intellectual property rights
Logo Design Viz or any of its subsidiaries, director, officer, affiliate, shareholder, employee, agent or representative in any event will not be held liable to a claim for damages by you or any third party making a claim on or your behalf, and also to any special, incidental, direct, indirect, disciplinary or consequential damages whatsoever arising out of or related to your contract, (including without limitation damages for loss of profits, loss of use, business interruption or loss of information or the cost of procurement of alternate products or services). Even in potential for such damages is advised to Logo Design Viz, whether such damages arising in contact, negligence, in justice, under statute at law or else. Logo Design Viz liability arising out of the contract will not exceed the aggregated amount paid by you to Logo Design Viz under contract for such product or service.
Any third party making a claim through you for any printing damages whatsoever (consist for example, yet not without any other printing concerns: typing or content errors, product delivery, color variation, pricing, condition of product upon delivery, necessity or quality of printed proofs,) Logo Design Viz OR ANY SUBSIDIARY, DIRECTOR, OFFICER, AFFILIATE, SHAREHOLDER, EMPLOYEE, AGENT, OR REPRESENTATIVE IN NO EVENT SHALL be liable to them or to you either, as printing services are provided by companies outside of Logo Design Viz, this may include the companies mentioned on our website.
A major colour variation is observed from RGB – (Computer Screen Colour) to printed colors. (PMS/Pantone or CMYK). It is highly recommended that printed proof is requested before placement or finalizing of your order from printing companies. Logo Design Viz will not be held responsible for color differences, costs of printing, or any other expenses related to printing after you have finalized your design because Logo Design Viz does not offer printing services and thus no refund will also be possible.
Logo Design Viz, its subsidiary, officers, directors, shareholders, affiliates, agents and employees are risk free against any loss and harmless from damage, cost, liability or cost of any kind, you give consent to indemnify all of the above and also to the expenses incurred by Logo Design Viz such as attorney's fee, due to third party demand, claim or otherwise, because of emergence of, identified to or otherwise attributable to the true or alleged breach or infringement of any intellectual property right emphasized by a third party, or otherwise occurring out of or related to (i) You providing any kind materials or intellectual property causing advancement of the project contemplated by your Contract, or (ii) Logo Design Viz products or services utilized by you which is accordance to your contact.
All web site screen and portions, graphics, original text, logos, site design, picture and icons as well as all the selection, format are all intellectual property of Logo Design Viz and hence constitute confidential and proprietary information that is protected by appropriate intellectual property and other laws. Strict prohibition of any lease, rent, sale, duplication, modification, distribution, alteration, publication or retransmission of any Logo Design Viz' intellectual property or proprietary, unless stated by Logo Design Viz in writing or otherwise stated by required law.
